“성정체성 관련 캘리포니아 주의 법안” 

며칠 전 캘리포니아 주지사가 AB1955 법률을 승인했다고 해서 시끄럽습니다. 이 부분에 대해서 조금 자세히 설명해 드립니다. 그동안 캘리포니아는 민주당을 중심으로 성소수자를 보호한다는 명목으로 많은 법률에 서명해 왔습니다.

몇 가지만 소개해 드리면, AB975는 2023-2024년에 걸쳐서 발효된 법안인데 부모는 반드시 자녀의 건강과 안전 및 복지를 위해서 자녀가 주장하는 성정체성을 인정해야 하고, 만약 인정하지 않을 경우 자녀 학대의 한 형태로 간주될 수 있으며, 그 결과로 부모는 양육권을 잃을 수 있다고 했습니다. 특별히 이혼해서 함께 살지 않는 부모는 자녀가 주장하는 성정체성을 인정할 경우에만 자녀를 만나는 것이 허락됩니다.

SB960은 2023년에 발효된 법안으로 유치원에서 고등학교까지 모든 학교에 남성용과 여성용이 아닌 성별에 무관한 화장실을 적어도 하나 이상 만들어야 한다는 법안입니다. 트렌스젠더나 무성애자가 심리적 압박을 느끼지 않고 화장실을 사용하도록 해 주겠다는 의도입니다.

그리고 이번에 승인된 법안은 AB1955라고 해서 학교와 교사는 학생의 프라이버시 보호를 위해서 학생이 원하지 않으면 학생의 성정체성을 부모에게 알리지 않아도 된다는 법안입니다. 본인의 성정체성은 전적으로 학생 본인이 결정해야 할 사안이므로 학교가 강제로 부모에게 알려서는 안 된다는 것입니다. 부모보다는 개인의 결정이 더 중요하다는 것입니다.

이 법안에는 몇 가지 용납될 수 없는 부분을 포함하고 있습니다. ▲첫 번째는 자녀에 대한 부모의 권리를 박탈한다는 것입니다. 부모는 당연히 자녀에 대해서 알 권리가 있고, 선도할 역할이 있는데 학교가 부모에게 자녀에 대해서 상관하지 말라는 것이 됩니다. ▲두 번째는 자녀교육을 위해서 전통적으로 중요시해 왔던 부모와 선생의 협력관계를 깨뜨려 버리고 서로가 속이는 관계를 만들어 놓는다는 것입니다. 그뿐 아니라 자녀가 부모를 속이는 것을 학교와 선생이 동조하고 도와주는 셈이 되는 것이지요. ▲세 번째, 이 법안에는 지나가는 말로 학교의 역할을 한 줄 적어 놓았는데, 그것이 저의 눈길을 끌었습니다. 학교는 아이들이 안전하게 공부할 수 있도록 환경을 조성하는 것과 학문을 가르치는 것에 몰두할 뿐 개인의 어떤 결정에도 영향을 미치지 않는다는 것입니다.

미국이 한국보다 교육이 우수하다는 얘기를 듣던 시절에 한국의 교육학자들이 미국을 부러워하면서 했던 말을 기억합니다. 한국의 학제는 그저 일류대학을 보내는 것에 몰두하는 반면, 미국의 학제는 좋은 시민을 만드는 데 있다. 그래서 일부 뛰어난 사람은 대학을 보내지만, 나머지 대다수의 사람은 건강한 정신을 가지고 자신이 가진 능력을 발휘해서 사회에 공헌하는 사람으로 만드는 것을 목표로 한다는 것이었습니다. 하지만 이제는 그 모든 교육을 포기하겠다는 말이 되는 것입니다.

테슬라의 회장인 일론 머스크는 이번 법안이 모든 직원의 가정의 미래를 위험하게 할 것이 분명하므로 테슬라에 이어 스페이스X의 본사도 텍사스로 옮기겠다고 발표해서 고맙게 느껴집니다. 처음에는 성소수자를 보호하겠다고 시작한 일이 보호의 차원을 넘어서 그들의 권리를 무한정 인정해 버림으로써, 이제는 소수의 폭력이 되어 버렸고, 보호를 받아야 하는 대상이 더 이상 그들이 아니라, 우리가 아닌가 하고 느껴지는 세상입니다.

CALIFORNIA’S NEW REGISLATION IN REGARDS TO GENDER IDENTITY

Recently, there has been a lot of noise because the Governor of California approved the AB1955 law. Over the years, California, led by the Democratic Party, has signed many laws under the pretext of protecting sexual minorities.

To introduce a few, AB975 is a bill that came into effect during 2023-2024, stating that parents must acknowledge their child’s asserted gender identity for the child’s health, safety, and welfare. If they do not, it could be considered a form of child abuse, and as a result, the parents could lose custody. Particularly, divorced parents who do not live together are only allowed to meet their child if they acknowledge the child’s asserted gender identity.

SB960 is a law that came into effect in 2023, requiring all schools from kindergarten to high school to have at least one gender-neutral bathroom, rather than separate male and female restrooms. The intention is to allow transgender or asexual individuals to use the restroom without feeling psychological pressure.

The recently approved law is AB1955, which states that schools and teachers do not have to inform parents about their child’s gender identity if the student does not wish to do so, in order to protect the student’s privacy. It asserts that the student’s gender identity is entirely their own decision, and the school should not forcibly inform the parents. The idea is that individual decisions are more important than parental authority.

This law contains several unacceptable aspects. Firstly, it deprives parents of their rights over their children. Parents naturally have the right to know about their children and the role of guiding them, but this law tells schools to disregard parental involvement. Secondly, it disrupts the traditionally important cooperation between parents and teachers in education, creating a relationship of deception. Additionally, it means that schools and teachers are aiding and abetting children in deceiving their parents.

Thirdly, the law has a passing reference that caught my eye. It states that schools should focus on creating a safe environment for children to study and on teaching academics, without influencing any personal decisions.

I remember the words of Korean education scholars who admired the American education system during the times when the U.S. was considered superior to Korea in education. They envied that while the Korean education system was focused on sending students to top universities, the American system aimed to produce good citizens. The goal was to cultivate individuals who could contribute to society with a healthy mindset and their abilities, even if not everyone went to college. But now, it seems that all those educational goals are being abandoned.

Elon Musk, the chairman of Tesla, announced that this law would undoubtedly endanger the future of all employees’ families, and therefore, he plans to move SpaceX’s headquarters to Texas following Tesla. This is a welcome move. Initially, the intention was to protect sexual minorities, but now it has gone beyond protection to unlimited recognition of their rights, which has turned into the tyranny of a minority. It feels like the ones who need protection now are us, not them.
